Terms of Service

These Terms of Service (“Terms”) govern your access to and use of PoolCodex (the “Service”), operated by PoolCodex(“we,” “us,” or “our”). By creating an account, accessing, or using the Service, you agree to these Terms. If you are entering into these Terms on behalf of a company, you represent that you are authorized to bind that company.
1. The Service
PoolCodex is a software platform that helps pool-construction businesses manage customers, estimates, proposals, electronic signatures, projects, and related workflows. We may add, change, or remove features over time.
2. Accounts & workspaces
You are responsible for the activity in your workspace, for maintaining the confidentiality of your credentials, and for your team members’ use of the Service. You must provide accurate information and keep it current. You must be at least 18 years old and legally able to enter into these Terms.
3. Subscriptions, trials & billing
Paid plans are billed in advance on a recurring basis through our payment processor. Free trials, where offered, convert to a paid subscription at the end of the trial period unless canceled beforehand; where a payment method is required to start a trial, you authorize us to charge it when the trial ends. Fees are non-refundable except where required by law or expressly stated. We may change pricing on prospective renewals with reasonable notice.
4. Your content & customer data
You retain ownership of the data you and your customers submit to the Service (“Your Content”). You grant us a limited license to host, process, and transmit Your Content solely to provide and improve the Service. You are responsible for having the rights and consents necessary to submit Your Content, including any personal information about your customers.
5. Electronic signatures
The Service enables you to send documents for electronic signature and to collect signatures from your customers. You are responsible for the content of those documents and for confirming that electronic signing is appropriate and enforceable for your use. Signatories’ use of the signing flow is also governed by our E-Sign Consent disclosure.
6. Acceptable use
You agree not to misuse the Service — including by attempting to breach security, access data that isn’t yours, disrupt the Service, upload unlawful or infringing content, or use the Service to send unsolicited messages. We may suspend or terminate access for violations.
7. Third-party services
The Service integrates with third parties (for example, payment processing and email delivery). Your use of those integrations may be subject to the third party’s terms, and we are not responsible for their acts or omissions.
8. Disclaimers
The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law. We do not warrant that the Service will be uninterrupted, error-free, or fit for a particular purpose. PoolCodex is a business-management tool and does not provide legal, tax, or engineering advice.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability arising out of or relating to the Service will not exceed the amounts you paid us in the 12 months before the event giving rise to the claim.
10. Termination
You may cancel at any time from your billing settings. We may suspend or terminate the Service for violations of these Terms or non-payment. On termination, your right to use the Service ends; we may delete your data after a reasonable period, subject to any legal retention obligations.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by reasonable means, and continued use after the changes take effect constitutes acceptance.
